4. Account Registration and Contact Information

You agree to provide accurate, current, and complete information when contacting us or entering into a service agreement. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.

5. Quotes, Estimates, and Contracts

Quotes and Estimates

Any quotes or estimates provided by Kitchen Bath Remodeler are preliminary and subject to change. Estimates are based on the information you provide and our initial assessment. Final project costs may vary based on unforeseen conditions, material availability, design changes, or other factors discovered during the course of work.

Quotes are valid for 30 days from the date provided unless otherwise specified.

Service Contracts

All remodeling projects require a signed written contract that outlines the scope of work, timeline, payment terms, materials, and other project-specific details. The contract will take precedence over these general Terms in the event of any conflict regarding the specific project.

You agree to read and understand the contract before signing. If you have questions about any terms in the contract, please ask before signing.

6. Payment Terms

Payment terms will be specified in your service contract. Generally, our payment structure includes:

  • An initial deposit to secure your project start date (typically 25-50% of the total project cost)
  • Progress payments at agreed-upon milestones
  • Final payment upon project completion and your approval

Payment Methods: We accept cash, checks, credit cards, and bank transfers. A processing fee may apply to credit card payments.

Late Payments: If payment is not received according to the agreed schedule, we reserve the right to suspend work until payment is received. Late payments may be subject to interest charges or late fees as specified in your contract.

Non-Payment: Failure to pay may result in termination of the project, legal action, and placement of a mechanic’s lien on your property as permitted by law.

7. Changes to Project Scope

If you wish to make changes to the project scope after the contract is signed, you must submit a written change order. Changes may affect the project timeline and cost. We will provide a revised estimate for your approval before proceeding with any changes.

Change orders must be signed by both parties before work on the change begins.

8. Project Timeline

We will provide an estimated project timeline in your contract. While we make every effort to complete projects on schedule, timelines are estimates and may be affected by factors beyond our control, including:

  • Material delays or backorders
  • Permit or inspection delays
  • Weather conditions
  • Unforeseen structural or code compliance issues
  • Client-requested changes

We are not liable for delays caused by such circumstances.

9. Permits and Code Compliance

Kitchen Bath Remodeler will obtain necessary permits for work as required by local building codes. Permit fees are typically included in your project quote or contract. You are responsible for providing access to your property for inspections.

If unforeseen code compliance issues are discovered during the project, additional work may be required. We will notify you of any such issues and obtain your approval for additional costs before proceeding.

10. Warranties and Guarantees

Workmanship Warranty: We stand behind the quality of our work. Kitchen Bath Remodeler provides a workmanship warranty on all completed projects as specified in your contract (typically 1-2 years from project completion).

Manufacturer Warranties: Materials, fixtures, appliances, and equipment are covered by their respective manufacturers’ warranties. We will provide warranty documentation for materials used in your project.

Warranty Exclusions: Our warranty does not cover damage resulting from misuse, neglect, normal wear and tear, alterations by others, or acts of nature. Routine maintenance is your responsibility.

To make a warranty claim, contact us in writing with a description and photos of the issue.

11. Limitation of Liability

To the maximum extent permitted by law, Kitchen Bath Remodeler’s total liability for any claims arising from or related to our Services shall be limited to the amount you paid us for the specific project or service giving rise to the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of use, loss of time, inconvenience, or damages to personal property not directly caused by our negligence.

12. Intellectual Property

All design plans, drawings, renderings, and other creative work produced by Kitchen Bath Remodeler remain our intellectual property unless otherwise specified in your contract. You are granted a license to use these materials solely for the purpose of completing your remodeling project.

You may not reproduce, distribute, or use our designs for other properties or projects without our written permission.

13. Photography and Marketing

We may request permission to photograph your completed project for use in our marketing materials, website, social media, and portfolio. Your participation is entirely voluntary. If you agree, you grant us a perpetual, royalty-free license to use photos of your project for promotional purposes.

We will not include your name, address, or identifying information without your separate consent.

  • Work already completed
  • Materials purchased or ordered specifically for your project
  • Any deposits or advance payments made

Refunds, if any, will be determined based on the stage of the project and costs incurred.

Company Termination: We reserve the right to terminate a project if you breach the contract terms, fail to make required payments, or engage in abusive or threatening behavior toward our staff.

16. Dispute Resolution

If a dispute arises regarding our Services, we encourage you to contact us first to seek an amicable resolution. Most issues can be resolved through open communication.

If a dispute cannot be resolved informally, you agree to participate in mediation before pursuing legal action. Any legal disputes will be governed by the laws of the state in which the services are performed and shall be resolved in the courts located in that jurisdiction.

17. Insurance and Licensing

Kitchen Bath Remodeler is properly licensed, bonded, and insured to perform remodeling work in the jurisdictions where we operate. We maintain general liability insurance and workers’ compensation insurance as required by law.

License numbers and insurance certificates are available upon request.

18. Subcontractors and Third Parties

We may engage qualified subcontractors to perform specialized work such as plumbing, electrical, HVAC, or other trades. All subcontractors are vetted and insured. We remain responsible for the overall quality and coordination of the project.

19. Safety

We maintain a safe work environment and follow OSHA guidelines and local safety regulations. During the project, the work area may present hazards. Please keep children and pets away from the work area at all times.

You agree to indemnify and hold Kitchen Bath Remodeler harmless from any injuries or damages resulting from your failure to restrict access to the work area.

20. Force Majeure

We are not liable for delays or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, labor strikes, material shortages, or other force majeure events.

21. Entire Agreement

These Terms of Service, together with your signed service contract (if applicable), constitute the entire agreement between you and Kitchen Bath Remodeler regarding the use of our Site and Services and supersede all prior agreements, understandings, or representations.
